Terms of Service

These Terms of Service govern the relationship between Palms Enterprises (the "Photographer") and the Client. By booking a session or submitting an enquiry, you agree to the following terms.

1. Bookings and Payments

• Deposit: A non-refundable booking fee of 25% of the total session fee is required to secure your date. Your date is not confirmed until this deposit has been received.
• Balance: The remaining balance must be paid in full at least 24 hours prior to the scheduled shoot.
• Payment Methods: We accept MCB Juice, Bank Transfer, and Cash.

2. Cancellations and Rescheduling

• Cancellations: If the Client cancels the session for any reason, the 25% deposit is non-refundable. It represents the loss of business and administrative costs incurred in reserving the date.
• Rescheduling: The Client may reschedule the session without penalty, provided that at least 72 hours' notice is given before the scheduled shoot. Rescheduling with less than 72 hours' notice may result in forfeiture of the deposit at the Photographer's discretion.

3. Image Delivery

• Turnaround: Final edited images will be delivered within 14 days of the shoot date.
• Format: The Photographer provides high-resolution, edited JPEG files only. RAW (unedited) files are the exclusive property of the Photographer and will not be released under any circumstances.

4. Intellectual Property and Usage Rights

• Copyright: In accordance with the Mauritius Copyright Act 2014, the Photographer retains full copyright ownership of all images created during the session.
• Client Licence: The Client is granted a licence for Personal Use only. This includes printing for personal enjoyment and sharing on personal social media accounts. The Client may not sell, sub-licence, or use the images for commercial purposes — including but not limited to editorial submissions, stock libraries, or advertising — without the prior written consent of the Photographer.
• Model Release: The Client grants Palms Enterprises the right to use session images for portfolio display, website content, and social media promotion. If you prefer that your images not be used in this way, please notify us in writing before the session.

5. Limitation of Liability

In the unlikely event of total photographic failure due to circumstances within the Photographer's control — including equipment malfunction or corrupted memory cards — the Photographer's liability is limited to a full refund of all fees paid by the Client, or a complimentary reshoot at a mutually agreed date. The Photographer accepts no liability for losses or damages beyond this amount.

The Photographer is not liable for photographic failure resulting from circumstances outside their control, including but not limited to severe weather, third-party interference, or venue restrictions.

6. Governing Law

These Terms of Service are governed by the laws of the Republic of Mauritius. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Mauritius.
